These Terms of Service (“Terms”) are a binding agreement between you and Clothwright (“Clothwright,” “we,” “us,” or “our”) governing clothwright.com, related services, and purchases from us. Please read them before placing an order.
1. Agreement and eligibility
By accessing the site, creating an account, or placing an order, you agree to these Terms and the policies incorporated here. If you do not agree, do not use the site.
You must be able to form a legally binding contract where you live. If you use the site for an organization, you represent that you have authority to bind it. The site is not directed to children under 13.
2. Clothwright products
Clothwright is a motivational clothing brand. Our creator develops the original concepts and designs. Products may be manufactured, printed, packed, or shipped by vetted third-party production and fulfillment partners, including partners outside the United States. A product may therefore ship directly from a partner and may arrive separately from other items.
Fiber content, country of origin, care instructions, fit information, and other product-specific disclosures shown on the product or its sewn-in label control over general descriptions on this site. “Soft,” “everyday,” and similar terms describe intended feel or use, but are subjective and are not performance guarantees. Unless expressly identified as such, our apparel is not protective, medical, safety, or all-weather equipment.
We try to display colors and details accurately, but screens, dye lots, print placement, and production batches can vary. We may correct errors, improve designs, or discontinue products without notice.
3. Orders and acceptance
Your order is an offer to purchase. An automated confirmation means we received it; acceptance occurs when we send a shipment confirmation or otherwise expressly accept the order. We may decline or cancel an order for suspected fraud, pricing or inventory errors, payment failure, legal restrictions, or limits imposed by a production partner. If we cancel after charging you, we will issue a refund.
You are responsible for accurate contact, sizing, personalization, and delivery information. Contact us promptly if something is wrong. Changes or cancellations may not be possible once production or fulfillment begins.
4. Prices, taxes, and payments
Prices are shown in U.S. dollars unless stated otherwise. Applicable taxes and shipping charges are displayed before purchase. We may change prices prospectively, but changes do not affect an accepted order.
Payments are processed by Stripe. Eligible customers may see Apple Pay or Google Pay presented by Stripe. Clothwright does not receive or store full card numbers, card security codes, or wallet device-account credentials. Your use of a payment method may also be governed by Stripe and the wallet provider’s terms.
5. Shipping and delivery
Our Shipping & Delivery Policy is part of these Terms. Delivery dates are estimates unless expressly guaranteed. We will use the shipment timeframe shown at checkout or in your order confirmation. If we cannot ship within the promised time, we will provide the legally required delay notice and a choice to consent to the delay or cancel for a prompt refund.
Risk of loss and title pass as provided by applicable law. You remain responsible for providing a deliverable address and for retrieving packages delivered according to carrier records.
6. Returns and refunds
Our Returns & Refunds Policy is part of these Terms. Nothing in these Terms limits rights that cannot legally be waived, including rights concerning defective, misdescribed, or undelivered goods.
7. Intellectual property
The site, Clothwright name and branding, original motivational designs, artwork, photographs, product copy, layout, and software are owned by Clothwright or its licensors and protected by intellectual-property laws. Your purchase gives you ownership of the physical product, not rights to reproduce, manufacture, distribute, mint, or commercially exploit its design.
You may use the site for personal, noncommercial shopping. You may not scrape it at scale, remove rights notices, copy designs, use our marks in a way that suggests endorsement, or use site content to train or supply a competing commercial system without written permission.
8. Reviews and submitted content
If you submit a review, photo, or other content, you confirm it is truthful, based on your genuine experience, and does not violate another person’s rights. You grant Clothwright a nonexclusive, worldwide, royalty-free license to host, display, reproduce, and adapt that content for operating and promoting the business, subject to our Privacy Policy. We may moderate content for relevance, safety, legality, or authenticity, but we will not condition an incentive on a positive review.
9. Acceptable use
You may not misuse the site, interfere with security, introduce malicious code, attempt unauthorized access, commit fraud, use automated means that unreasonably burden the service, impersonate another person, or use the service in violation of law.
10. Motivational content and service disclaimer
Clothwright’s words and designs are intended for creative expression and general encouragement. They are not medical, mental-health, financial, legal, or professional advice and are not a substitute for qualified care.
To the fullest extent permitted by law, the site is provided “as is” and “as available.” We do not promise uninterrupted or error-free access. Products remain covered by any express description and by warranties or consumer rights that applicable law does not allow us to disclaim.
11. Limitation of liability
To the fullest extent permitted by law, Clothwright will not be liable for indirect, incidental, special, exemplary, or consequential damages arising from site use. Our aggregate liability for a claim relating to a product will not exceed the amount paid for that product, except where applicable law requires otherwise.
Some jurisdictions do not allow certain warranty exclusions or liability limits. In those jurisdictions, these provisions apply only to the extent allowed. Nothing excludes liability for fraud, willful misconduct, personal injury caused by negligence, or another liability that cannot legally be excluded.
12. Governing law and disputes
Before filing a formal claim, please email us with a description of the problem and the resolution you seek. We will try in good faith to resolve it.
Launch item: replace this paragraph with the governing state, venue, and any attorney-approved dispute process for Clothwright’s actual legal entity. Do not publish a mandatory arbitration or class-action waiver without advice from qualified counsel.
13. Changes and termination
We may update these Terms prospectively. The effective date identifies the current version. Material changes will be communicated as required by law. We may suspend access for material violations, but obligations connected to completed purchases survive.
14. Contact
Questions about these Terms may be sent to legal@clothwright.com.
Launch item: add Clothwright’s full legal entity name and business mailing address here before accepting orders.
